Terms of Use


  1. Welcome
    • These terms of use (together with any other policies or terms referred to in it) sets out the terms on which you may make use of the DOHYO platform and website dohyoapp.com (our Platform), whether as a guest or a registered DOHYO user. Use of our Platform includes accessing, browsing, or registering to use our Platform and any of the services made available on our Platform, including the DOHYO applications (and mobile applications), widgets, and DOHYO software (Services).
    • Please read these terms of use carefully before you start to use DOHYO, as these will apply to how you use the Platform.
    • By using and continuing to use the Services, whether or not you access the Services through the Platform, a mobile device, a mobile application or computer, you confirm that you accept these terms of use and that you agree to comply with them.
    • If you do not agree to these terms of use please stop using our Platform and the Services.
    • We also need you to read the following terms which are important and which relate to how you use the Services:
      • DOHYO Privacy Policy. This sets out what personal data we collect from you, what we do with it and how we share it. By using our Platform you agree to us using your personal data in this way. You also confirm that all of the information you provide is correct and accurate.
      • DOHYO Cookie Policy, which sets out information about the cookies on our Platform.
  1. Who we are
    • com is a Platform operated by DOHYO Limited (“we”). We are a limited company, registered in England and Wales under company number 09458121 and have our registered office at Athene House, Suite J, 86 The Broadway, Mill Hill, London NW7 3TD.

  2. What is DOHYO?

DOHYO is a platform which allows you to make predictions for competitive events, and in particular for real time sports events. Once you have signed up to the DOHYO community you will be able to create and join contests and see how accurate you are with your predictions. DOHYO users can play against existing DOHYO users or invite new users to take part. If you create your own contest, as the games master you can determine the length and the prize of the contest. You will be awarded points depending on how accurate your predictions are and your point total will be shown on the DOHYO leader board. As part of the DOHYO community all DOHYO users will be able to see how other DOHYO users are doing.

  1. Your DOHYO account
    • Before you can start to use the Services you need to create your own DOHYO account. The information that you provide us must be accurate and complete. DOHYO is not a commercial platform – it is designed to be used for individuals for their personal use. DOHYO is not directed to persons under the age of 18 and all DOHYO users must be over 18 years. Remember to keep your login details and password for your account confidential. Don’t share it with any third party. If you think someone has accessed your account without your consent or knows your account login details, please change your password immediately and write to us to let us know.
    • The Services are made available to you free of charge. If this changes we will write to you to let you know.
    • Where you offer any prizes in connection with any contests you must comply with paragraph 8.1.2 and any other guidelines that we may post from time to time on our Platform. Please ensure that you check these guidelines regularly.
    • If we think you have failed to comply with any provisions of these terms of use or any other instructions then we will immediately suspend and disable your DOHYO account.
  2. Accessing our Platform
    • We cannot guarantee that the Services will always be made available to you or that access will be uninterrupted. Access to the Services is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Services without notice. We will not be liable to you if for any reason our Platform is unavailable at any time or for any period.
    • You are responsible for making all arrangements necessary for you to have access to the Services.
  3. Intellectual Property Rights
    • We are the owner or the licensee of all intellectual property rights in the DOHYO platform/application, and in the material and content published on it.   Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
    • You must not use any part of our Platform or the Services for commercial purposes without obtaining a written licence to do so from us or our licensors.
    • If you print off, copy or download any part of our Platform or the Services without our consent, your right to use our Platform or the Services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
  4. Limitation of our liability
    • Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
    • To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Platform or the Services or any content on the Platform, whether express or implied.
    • Subject to paragraph 7.1, we will not be liable to any visitor or user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
      • use of, or inability to use, any part of our Platform or the Services;
      • use of or reliance on any content displayed on our Platform or the Services ;
      • loss of profits;
      • loss of anticipated savings;
      • loss of business opportunity, goodwill or reputation;
      • any loss of data or any damage covered to your mobile device, computer hardware or software;
      • any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Services or to your downloading of any content on it, or on any website linked to it; or
      • any indirect or consequential loss or damage.
    • Subject to paragraph 7.1, our total liability to you in respect of all losses arising under or in connection with the Platform or the Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, will in no circumstances exceed £50. This is the limit of our liability to you.
    • DOHYO is made available only for domestic or private use. You must not use DOHYO for any commercial or business purposes.
    • We assume no responsibility for the content of website linked on DOHYO. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
    • The content on DOHYO is provided for general information only. It is not intended to amount to advice on which you should rely. Any views expressed by any other DOHYO users are their own and you should always rely on your own judgment, skill and ability.
  5. DOHYO Community Rules
    • Whenever you make use of a feature that allows you to interact with our Services, upload content to the Platform, or to make contact with other DOHYO users, you must comply with the following rules:
      • we expect all of our DOHYO users to comply with the law. You cannot use DOHYO in any way or manner that:
        • breaches any applicable local, national or international law or regulation;
        • is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
        • is for the purpose of harming or attempting to harm minors in any way;
        • means that you transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); and
        • means that you knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware or mobile device.
      • We want to encourage our DOHYO users to make their contests and competitions as exciting and enticing as they can and to this end we encourage you to be as creative as you want with the prizes that you offer. In addition to the rules set out in these terms, if the prize is associated with any marketing, promotion, sponsorship, endorsement or other commercial activity (whether or not directly or indirectly and whether or not you directly or indirectly gain any financial or other monetary compensation from such prize offering) you must comply with the following rules:
        • you must obtain our written consent before offering any prize(s);
        • you cannot offer a prize if we have not provided our written approval;
        • please ensure that you write to us as soon as you can to ensure that there are no delays which may affect your contest;
        • you must provide a detailed description of the prize, its monetary value and the origin of the prize.

We will endeavour to respond to any prize approval request within 48 hours. We can withhold our consent for any reason. We are not responsible or liable for any missed contest launches or start times as a result of any delays in responding to any prize approval requests.

  • You also agree:
    • not to reproduce, duplicate, copy or re-sell any part of our Platform or the Services;
    • not to access without authority, interfere with, damage or disrupt:
      • any part of our Platform or the Services;
      • any equipment or network on which our Platform or the Services are stored;
      • any software used in the provision of our Platform or the Services; or
      • any equipment or network or software owned or used by any third party.
    • not to carry out any activity on DOHYO which:
      • is obscene, offensive, hateful or inflammatory;
      • promotes sexually explicit material;
      • promotes violence;
      • promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
      • is an infringement of a third party’s copyright, database right or trade mark of any other person;
      • is likely to deceive any person;
      • is threatening, abusive, or invade’s another person’s privacy; or
      • gives the impression that it emanated from us or that we endorsed or approved such activity;
    • As part of the DOHYO community you may have access to a variety of interactive services within the Platform, including, without limitation any of the following:
      • chat rooms;
      • notice boards;
      • DOHYO prediction services;
      • DOHYO match statistics; or
      • Match odds and accumulator
    • (the “interactive services”).
    • Where we do provide any interactive service, we will let you know what kind of services are being offered, if the service is moderated and what form of moderation is used (including whether it is human or technical).
    • We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided as part of our Platform, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide as part of our Platform, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.
    • The use of any of our interactive services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not fool proof. Minors who are using any interactive service should be made aware of the potential risks to them.
    • Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.
    • By using the Platform and in particular any of the interactive services, you acknowledge that we may (but we are not obligated to) monitor, moderate or review any content or activities that you post to or perform on the Platform. We may delete all or any part of any content that we consider, in our sole judgement, does not comply with these terms.
    • You warrant that if you do not comply with these rules, you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
    • Any content you upload to our Platform will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you grant us and other DOHYO users a limited licence to use, store and copy that content and to distribute and make it available to third parties. The rights you license to us are described in the next paragraph (Rights you license).
    • We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to DOHYO constitutes a violation of their intellectual property rights, or of their right to privacy.
    • We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other DOHYO user.
    • We have the right to remove any competition, posting or any other contribution you make to our Platform if, in our opinion, you have not complied with the DOHYO rules.
    • The views expressed by other users on our Platform do not represent our views or values.
  1. Viruses
    • We do not guarantee that the Services will be secure or free from bugs or viruses.
    • You are responsible for configuring your information technology, computer programmes, mobile devices and platform in order to access the Services. You should use your own virus protection software.
    • You must not misuse our Platform by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Platform or the Services, the server on which the Services are stored or any server, computer or database connected to the Services. You must not attack our Platform or the Services via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Platform or the Services will cease immediately.
  2. Linking to our Platform
    • No framing and no linking (except with our permission) is permitted.
    • You may link to our landing page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
    • You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to any part of our Platform or the Services in any website or application that is not owned by you.
  3. General legal information

Before we finish, we also need to tell you the following:

  • these terms may be changed from time to time, and when we do this we’ll let you know on the Platform. By continuing to use any part of our Platform or the Services we will take this as meaning that you agree and accept our updated terms. You should check our terms from time to time to make sure that you are happy with any changes;
  • we are allowed to assign (pass on) our benefits or subcontract all or any of our obligations under these terms;
  • these terms, the Privacy Policy and our Cookie Policy constitute the entire agreement between us and replace all other agreements or arrangements, whether written or oral, express or implied. We both agree that in entering into these terms neither of us relies on and will have no remedy in respect of any statement, representation, warranty or understanding of any person, whether party to these terms or not, other than as expressly stated in these terms;
  • these terms are governed by English law. In the event of a dispute, we agree that the courts of England and Wales will have the non-exclusive jurisdiction to determine and resolve the dispute between us;
  • your access to the Platform and use of the Services may be subject to other laws and you must comply with all applicable laws and regulations (whether of the country in which you reside or from which you access the Platform or Services, or otherwise). We will not be liable or responsible if you break any such law or regulation; and
  • we make no representation that the Platform or the Services are appropriate or available for use in a jurisdiction where the Platform, use of and access to the Platform or use of any of the Services is not permitted. If you access the Platform or use the Services from any such jurisdiction, you do so out of your own volition.
